　　堕胎权一直是美国两党持续拉锯的焦点议题,虽然美国在1973年开始就将堕胎合法化,但是这几年,美国多个保守州却兴起了一阵对堕胎实行法律限制的浪潮,这些堕胎禁令无一例外都遭到了当地社会组织的抗议和起诉。然而,就在9月1号,德克萨斯州突然宣布本州的反堕胎法正式实行,这成了迄今为止最为严苛的一份堕胎禁令。这个禁令规定了哪些内容?又是如何通过的呢?让我们跟着 Natasha 老师一起来读今天的文章。

After silence from Supreme Court ,Texas clinics confront near - total abortion ban

在最高法院保持沉默后,德克萨斯州的诊所面临着近乎全面禁止的堕胎法

 

今年5月19号德州通过全美最严苛的《心跳法案》( Texas Heartbeat )

• 美国煤体称,该法案几乎肯定会面临联邦法律的挑战。

 

8月30号,一些堕胎诊所和支持堕胎组织向联邦最高法院上诉,要求最高法禁止《心跳法案》实施(负责此案的是保守派大法官 Samuel Alito )

• 对于得州即将生效的心跳法”,两天内设有任何一名大法官发布声明回应请求。

 

由于最高法院保持沉默,今年9月号《心跳法案》正式实行( PS :本文的刊发时间为当地时间9月1号)

9月2号晚,美国最高法院以5比4的投票结果决定,拒绝废除德州堕胎禁令,因此该法律顺利生效。

 

A Texas law prohibiting most abortions after about six weeks of pregnancy went into effect Wednesday after the Supreme Court did not act on a request to block it , ushering in the most restrictive abortion measure in the nation .

在德克萨斯州,反堕胎法已于周三生效,这条法律禁止绝大多数妇女在怀孕约6周后堕胎。此前,美国最高法院收到了阻止该法律的请求,但它没有采取相应的行动。由此,美国诞生了最为严苛的反堕胎法令。

 

 The justices may still rule on the request . In the meantime , though , access to abortion in Texas has become extremely limited , the latest example of a Republican - led state imposing new constraints on ending pregnancies .

 The law , known as Senate Bil 8, amounts to a nearly complete ban on abortion in Texas because 85% to 90% of procedures in the state happen after the sixth week of pregnancy , according to lawyers for several clinics .

Many who oppose abortion said they were cautiously optimistic that the Supreme Court might allow the law to stand for now and were

The Texas law , which makes no exceptions for pregnancies resulting from incest or rape , bars state officials from enforcing it and instead

deputizes private individuals to sue anyone who performs the procedure or " aids and abets ＂ it .

The patient may not be sued , but doctors , staff members at clinics , counselors , people who help pay for the procedure and even an Uber driver taking a patient to an abortion clinic are al potential defendants . Plaintiffs are entitled to $10,000 and their legal fees recovered if they win .Prevailing defendants are not entitled to legal fees .

堕胎的孕妇可能不会被起诉,但做手术的医生、诊所的工作人员、咨询人员、帮助支付手术费用的人,甚至开车将孕妇送到堕胎诊所的优步司机都是潜在的被告。如果原告胜诉了,他们有权获得1万美元的赔偿,且不需要支付诉讼费。而胜诉的被告人将无权获得相关法律费用的补贴。
